Terms and Conditions

Terms governing the use of NSECUR products, platforms, and cybersecurity services.

Welcome to NSECUR Infosec LLC. These Terms and Conditions ("Terms") govern your access to and use of our website, products, platforms, applications, and services related to cybersecurity (collectively, the "Services").

Please read these Terms carefully before accessing or using any part of our Services. By accessing, browsing, or using the Services, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Services.

1. Definitions

  • Client / You / User: Any person or legal entity who accesses or uses the services of NSECUR.
  • Services: All cybersecurity solutions offered by us, including penetration testing, security assessments, consulting, threat detection, and any deliverables.
  • Confidential Information: Any non-public information, whether oral, written, digital, or otherwise, disclosed by either party to the other.
  • Agreement: These Terms and Conditions together with any written Service Level Agreement (SLA), Proposal, or Quotation accepted by the Client.

2. Scope of Services

NSECUR provides a wide range of cybersecurity services, including but not limited to:

  • Network & Application Vulnerability Assessment
  • Penetration Testing (Black Box, White Box, Grey Box)
  • Security Configuration Audits
  • Cloud & Infrastructure Security Assessment
  • Incident Response & Forensics
  • Risk Management & Compliance Advisory (ISO 27001, NIST, GDPR)
  • Security Awareness Training
  • Managed Security Services

Each service engagement is defined by a separate agreement or proposal.

3. Eligibility and Client Obligations

  • You are at least 18 years of age.
  • You have the authority to act on behalf of your organization and enter into a binding agreement.
  • You will provide accurate, complete, and lawful information.
  • You will grant timely access to systems, networks, and personnel necessary for service delivery.
  • You will not use our services to exploit, harm, or attack any system without authorization.

4. Confidentiality

  • To keep confidential all information shared during or as part of the engagement.
  • Not to disclose confidential information to any third party without prior written consent.
  • Confidentiality obligations shall survive the termination of the Agreement for a period of five (5) years.

5. Data Security and Privacy

  • Collected data is used only for providing services.
  • Sensitive data is encrypted and securely stored.
  • No client data is sold or shared for commercial purposes.
  • Logs and reports are destroyed upon request or after 90 days, unless agreed otherwise.

6. Service Deliverables and Reports

  • For client internal use only.
  • Not to be disclosed publicly without written consent.
  • Prepared with due diligence, but we cannot guarantee 100% vulnerability detection or threat coverage.

7. Intellectual Property Rights

  • All intellectual property (IP), tools, scripts, and content developed by NSECUR remain our exclusive property.
  • Clients are granted a non-transferable, non-exclusive license to use the final deliverables for internal business purposes.
  • Clients shall not modify, reverse-engineer, or repackage deliverables without written consent.

8. Payment Terms

  • Fees for services are outlined in the quotation/proposal.
  • Payment is due as per the agreed schedule (e.g., 50% upfront, 50% upon completion).
  • Late payments beyond 30 days may incur a 1% monthly late fee and may lead to suspension of services.
  • All prices are exclusive of taxes unless otherwise stated.

9. Service Level Agreements (SLAs)

  • Response times
  • Resolution timelines
  • Escalation procedures
  • Service uptime guarantees

SLAs are binding only when included in a signed agreement.

10. Limitation of Liability

  • NSECUR shall not be liable for indirect, incidental, punitive, or consequential damages.
  • Our liability for any claim is limited to the amount paid by the Client for the specific service in question.
  • We do not guarantee that all vulnerabilities or threats will be discovered or eliminated.

11. Warranties and Disclaimers

  • We provide services on a "best-effort" and "as-is" basis.
  • We do not warrant that the services will be error-free, secure, or uninterrupted.
  • We are not responsible for post-engagement misuse, security breaches, or third-party issues.

12. Termination

  • By either party with 30 days' written notice.
  • Immediately, if either party breaches any material obligation.
  • Upon termination, all outstanding payments become due, and services will cease.

13. Force Majeure

NSECUR shall not be liable for failure to perform its obligations if such failure is due to events beyond its reasonable control, including but not limited to natural disasters, internet outages, cyber-attacks, strikes, government actions, or war.

14. Third-Party Tools and Links

We may use or reference third-party tools, platforms, or services. We are not liable for any issues arising from third-party content, software, or links.

15. Amendments to Terms

At any time, we have the right to change these Terms. We'll update our website with the latest versions. Acceptance of the revised Terms is implied by continuing to use our services following revisions.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable laws. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.

17. Entire Agreement

These Terms, along with any signed proposals or SLAs, constitute the entire agreement between the parties and supersede all prior discussions, communications, or agreements.
